Acceptable Use Policy

1. Scope and Purpose

This Acceptable Use Policy (“AUP”) governs all use of Real Influencer Studios LLC d/b/a RealInfluencer (the “Company,” and the “Service”), including the consumer web application, the iOS application, any other web surface, the developer API, the reference-photo upload feature, the export and share features, and any creator-page or product-promotion feature the Company may operate. By accessing or using the Service — including by uploading any image, submitting any prompt, generating any output, exporting or sharing any output, or distributing any content created with the Service — you agree to this AUP. This AUP is incorporated into and forms part of the Terms of Service.

The Service is a tool for generating AI-generated content depicting fictional AI personas that are explicitly not real people. The Company is a content-generation tool, not a distributor or publisher of your content: the Service does not connect to, post to, schedule on, or message from your social-media or other third-party accounts. You — the user — are the operator and deployer of the content you create. You alone are responsible for what you generate with the Service and for what you subsequently post, publish, distribute, sell, or otherwise make available anywhere.

One floor, no exceptions. The Service generates advertising and marketing content. Sexually explicit and nude content is prohibited (Section 2) and is not a feature of the Service; the Company does not offer, build, or plan a sexually explicit or adult surface. The absolute prohibitions in Section 2 apply to all use of the Service without exception— there is no account tier or context in which they are permitted.

2. Absolute Prohibitions — Zero Tolerance (All Surfaces, No Exceptions)

The following are strictly and absolutely prohibited on every surface of the Service, with zero tolerance and no appeal. You may not use the Service to generate, request, upload, seed, store, export, share, distribute, solicit, or attempt any of the following. Violation results in immediate termination, preservation of evidence, and reporting to the National Center for Missing & Exploited Children (“NCMEC”) and/or law enforcement where legally required (see Section 6).

2.1 Child sexual abuse material and any sexualization of minors — zero tolerance

You may not create, request, upload, seed, attempt, export, share, or distribute any content that:

  • (a) depicts, appears to depict, or describes a minor (any person under 18, or who is depicted, described, or could reasonably be perceived as under 18) in any sexual, sexualized, nude, partially nude, suggestive, or intimatecontext — whether the depiction is photographic, illustrated, animated, computer-generated, “virtual,” fictional, or otherwise;
  • (b) is, appears to be, or is intended to be child sexual abuse material (CSAM) of any kind;
  • (c) depicts a person who looks, is styled, or is described as under 18 (“apparent minor”) in any sexual, suggestive, intimate, or nude context — including a real adult made to appear underage, and any character, persona, or output that reads as a minor;
  • (d) constitutes “age-play,” “ageplay,” “loli/shota,” “schoolgirl/schoolboy” sexualization, or any other framing that sexualizes, eroticizes, or romanticizes minority or apparent minority;
  • (e) uses any prompt, reference, caption, hashtag, tag, persona attribute, or metadata intended to make a sexual, suggestive, or nude depiction read as younger, underage, or child-like.

This prohibition is absolute and applies to all use of the Service.It is not subject to any “fictional,” “artistic,” “satire,” or “consenting adult role-play” exception. There is no appeal for a Section 2.1 violation.

2.2 Non-consensual intimate imagery and sexual content of real people

You may not create, request, upload, seed, export, share, or distribute:

  • (a) non-consensual intimate imagery (NCII)— any nude, sexual, or intimate depiction of an identifiable real person produced or shared without that person’s consent, including “deepfake” or “nudify”-style alterations of real photos;
  • (b) sexual, suggestive, intimate, or nude content depicting any identifiable real person(by face, body, name, or other identifying feature) without that person’s documented, verifiable consent — this includes celebrities, public figures, private individuals, and acquaintances;
  • (c)any content that takes a real person’s image and places them in a sexual, suggestive, compromising, or intimate context.

2.3 Impersonation, deepfakes, and misuse of real people’s likeness

You may not use the Service to:

  • (a) create, export, share, or distribute content depicting an identifiable real person without that person’s documented consent, including any persona built from, conditioned on, or designed to resemble a real individual;
  • (b) impersonate any person or entity, or create deceptive deepfakes— content presented as a genuine depiction of a real person, real event, or real statement that did not occur;
  • (c) generate content of public figures, politicians, or candidates designed to deceive, defame, defraud, manipulate an election, or misrepresent their words or conduct;
  • (d) create content that harasses, defames, defrauds, extorts, threatens, or stalks any real person, or that fabricates misleading content about real people or real events;
  • (e) imitate, clone, or replicate the VOICEof any real, identifiable person (living or, where protected, deceased) without that person’s documented consent or other legal right, or direct any persona’s voice to impersonate a real person.

Reference photographs you upload must satisfy the upload warranties in Section 4.

2.4 Other absolutely prohibited content

You may not create, request, upload, seed, export, share, or distribute content that depicts, promotes, facilitates, or solicits:

  • (a) bestiality or sexual content involving animals;
  • (b) incest or sexual content framed as occurring between family members;
  • (c) rape, sexual assault, or non-consent presented as endorsing, glorifying, or eroticizing the act; sexual violence; or trafficking;
  • (d) extreme gore, graphic real-world violence, mutilation, torture, or content created to shock or glorify violence;
  • (e) terrorism, violent extremism, or content that promotes, praises, provides material support to, or recruits for a terrorist or violent-extremist organization;
  • (f) self-harm or suicide that encourages, instructs, or glorifies the act;
  • (g) the planning, promotion, or facilitation of illegal acts— including the sale of illegal drugs, weapons, or other regulated goods; human trafficking; child exploitation or grooming; or any criminal activity;
  • (h) hate or harassment that incites or promotes violence or discrimination against people on the basis of a protected characteristic.

3. User Warranties

By using the Service, you represent and warrant, on a continuing basis, that:

  • (a) you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and have the legal capacity to agree to this AUP;
  • (b) every reference image, photo, face, or other input you upload or provide is yours, or you hold all rights, licenses, and consents necessary to upload it and to use it to generate content through the Service;
  • (c) no input you provide depicts a minor and no input depicts an apparent minor in any prohibited context;
  • (d) no input you provide depicts any other real, identifiable person without that person’s documented, verifiable consentto that specific use, and your inputs infringe no third party’s right of publicity, privacy, intellectual property, or other right;
  • (e) no input you provide is known or suspected illegal imagery, including any CSAM or NCII;
  • (f) your use of the Service, and your generation, export, posting, and distribution of any output, complies with all applicable laws and with the rules of every platform on which you post;
  • (g) the content you generate depicts fictional AI personas and not real people, except where you have the documented consent required under (d);
  • (h) any caption, hashtag, product claim, or other text you publish with an output— including text the Service authored for you and that you then adopt and post — is one you have reviewed, adopted as your own, and that complies with all applicable laws and platform rules. The Service may generate caption/hashtag text for your convenience; you remain the author and publisher of any text you choose to post.

You acknowledge that the AI personas produced by the Service are fictional and not real individuals, and you will not represent them as real people in any way that is deceptive or unlawful.

4. Upload-Specific Rules (Reference-Photo / Metered Upload Feature)

The Service permits you to upload reference photographs to seed generation. The upload feature is metered and subject to allowances by tier; it is also subject to automated and/or manual safety screening at ingress(the Company is entitled to run such screening; the precise screens enabled at any time are the Company’s operational choice). When you use the upload feature, the following rules apply in addition to Sections 2 and 3:

  • (a) No minors. You may not upload any photo of a minor, of an apparent minor, or of yourself if you are under 18, for any purpose.
  • (b) No third-party likeness without consent.You may not upload a photo of any real person other than yourself unless you hold that person’s documented, verifiable consentto upload it and to generate content from it. Uploading a celebrity, public figure, acquaintance, or any other person’s photo without such consent is prohibited.
  • (c) No known or suspected illegal imagery. You may not upload any CSAM, NCII, or other illegal image, or any image you have reason to believe is illegal.
  • (d) Screening and quarantine. The Company may screen uploads before storage or use. The Company may block, quarantine, and preserve any upload that triggers a safety signal, and will not return detail on why an upload was blocked. A blocked upload does not waive any obligation the Company has to preserve evidence or report.
  • (e) No evasion. You may not crop, edit, obscure, caption, tag, or otherwise manipulate an upload, or chain uploads, to evade screening or to make a prohibited depiction.
  • (f) No training; processing only. You acknowledge and agree that the Company processes your uploaded references only to generate your requested content and does not train any model on your uploads and does not sell your uploads. The Company may transfer the data asset in a future merger, acquisition, or asset sale; this is not a present-day sale of your data. (This mirrors the Privacy Policy; the controlling language lives there.)
  • (g) Recordkeeping. You are responsible for retaining the consents and rights documentation supporting your uploads, and for producing them on lawful request.

5. User Obligations (Generation, Export, Posting, and Distribution)

You are responsible for everything you do with the Service and for everything you do with its outputs, including downstream. The Service provides generation and packaging tools (including export of a labeled copy, an optional caption/hashtag authoring pass, an optional public share page, and an optional self-asserted “Posted” marker); it does not post, schedule, or distribute on your behalf, and it does not connect to your social or third-party accounts. You agree that:

  • (a) You are responsible for what you generate AND for what you export, post, or distribute. The Company provides a generation and packaging tool; you are the operator and deployerof the content. Once you export, post, publish, share, sell, or otherwise distribute an output — on any platform or surface, including any public share page the Service hosts for an output you make public — the responsibility for that content and its consequences is yours.
  • (b) You will disclose AI generation when you post. When you publish or distribute content created with the Service, you will clearly and conspicuously disclose that it is AI-generated, as required by applicable law and by the rules of the platform on which you post (e.g., Instagram, TikTok, YouTube). The AI-disclosure obligation is yoursas the deployer: when you post, you will use the posting platform’s AI-disclosure mechanism (for example, its “AI-generated” label) and make any disclosure the law requires. The Company embeds an invisible, machine-readable AI content-credential in your Output and applies no visible watermark, so the conspicuous, human-visible disclosure when you post is yours to make. You will not represent or imply that Output is entirely human-generated, or that a persona is a real person, independent of whether a specific disclosure is required by law or platform.
  • (c) You will make required disclosures.When the posting platform or applicable law requires an AI-generated disclosure, you will provide it (for example, by using the platform’s “AI-generated” label), and you will not misrepresent AI-generated Output as human-made. You will not remove or defeat any machine-readable provenance signal that an upstream model or the Service includes in an output.
  • (d) You will not use outputs to harass, defame, defraud, deceive, or mislead. You will not use outputs to harass, defame, threaten, extort, or impersonate any person, or to create misleading content about real people, real events, products, or affiliations, or to commit fraud or any unlawful act.
  • (e) You will respect platform rules and third-party rights.Your export, posting, and distribution will comply with the terms of every platform you use and will not infringe any third party’s intellectual property, publicity, privacy, or other rights.
  • (f) Captions and product claims are yours. Where the Service authors caption or hashtag text for you, you are responsible for reviewing it and for the truth, compliance, and lawfulness of anything you post. You will not publish captions or claims that are deceptive, that make unsubstantiated health/earnings/performance claims, or that omit a disclosure the law or platform requires (including, where your persona promotes a product, any required #ad / material-connectionand AI-persona disclosure — see Section 8). You will notpresent a persona’s statement as a real, unaffiliated consumer’s review or testimonial, or as a genuine personal experience or result the persona did not have (a fabricated “I used this and …” claim is deceptive even with an AI label), and you will not buy, sell, or procure fake indicators of social-media influence (16 CFR Part 465).
  • (g) You will not misuse the Service technically — no scraping or strip-mining of the reference pool or catalog, no automated abuse, no circumvention of safety screening, rate limits, metering, or access controls, no reselling of access except as expressly permitted, and no use of the developer API to do anything this AUP prohibits.
  • (h) You will not attempt to defeat the safety systems— including by prompt-injection, jailbreaking, obfuscated prompts, model-routing tricks, chained edits, or any method intended to produce, export, or share content prohibited by Section 2.

6. Enforcement, Reporting, and Appeals

The Company may enforce this AUP at its discretion and may act without prior notice where it deems necessary. Enforcement may include any of the following, alone or in combination:

  • (a) Content action— removing, blocking, disabling, quarantining, un-sharing a public share page, or refusing to generate, export, or store content;
  • (b) Account action— warning, suspending, rate-limiting, restricting features (including upload, export, share, or creator-page features), or permanently banning an account and any associated accounts;
  • (c) Preservation— preserving content, account data, logs, and related records as evidence consistent with the Company’s legal obligations;
  • (d) Reporting reporting to NCMEC (CyberTipline) and/or to law enforcement where legally required, including the non-delegable federal reporting duty for apparent CSAM, and cooperating with lawful requests;
  • (e) Referral and recovery— referring matters to authorities and pursuing the indemnification and other remedies in the Terms of Service.

No appeal for child-safety violations. Determinations under Section 2.1 (CSAM / minors / apparent minor / age-play) result in immediate permanent termination with no appeal. For other enforcement actions, the Company may, at its discretion, offer a limited review process; the existence of any review process does not limit the Company’s right to act immediately.

7. Relationship to the Terms of Service; Changes

This AUP supplements and is governed by the Terms of Service, including its indemnification, limitation-of-liability, disclaimer, governing-law, and dispute-resolution provisions. The Terms of Service and this AUP are governed by Missouri law (the Company is a Missouri LLC); any reference to Delaware in an earlier draft is superseded. You indemnify the Company for your violation of this AUP and for any content you generate, export, post, or distribute, as set out in the Terms of Service. In the event of a conflict between this AUP and the Terms of Service regarding prohibited conduct, the more restrictive provision controls.

The Company may update this AUP from time to time. Material changes will be communicated as required by the Terms of Service, and continued use after an update constitutes acceptance.

8. Product Promotion by AI Personas (Commerce Layer)

This Section applies when you use the Service to have your AI persona promote a product— your own product or a product reached through an affiliate link.

When your AI persona promotes a product, you agree that:

  • (a) You are the sole advertiser. The product claim, the offer, and the endorsement are yours. The Company hosts generation, packaging, and (where offered) a creator page and tracked links; it is not the seller of record, the advertiser, or a party to your transaction with any third party.
  • (b) You will make every disclosure the law requires. Where your persona promotes a product, you will clearly and conspicuously disclose (i) that the content is AI-generated and (ii) any material connection between you and the product (e.g., #ad, affiliate relationship, paid partnership), as required by the FTC Endorsement Guides (16 CFR Part 255) and any applicable state law. The disclosure duty is yours.
  • (c) No prohibited claims. You will not publish health, medical, earnings, income, or performance claims that are false, unsubstantiated, or that you cannot substantiate; you will not impersonate a real endorser; and you will not fabricate reviews, testimonials, or results.
  • (d) Earnings settle to you directly. Where the Service attributes affiliate or commerce earnings to your content, those earnings settle to your affiliate/platform accounts; the Company does not custody, hold, split, or pay out your commission. You authorize only the read-only attribution described in the Privacy Policy and provide account credentials by reference, never raw.
